RERA was notified in Bihar on May 2017 with most of the sections of the notifications being in line with the Central Act. Dilutions included allowance of the compounding of punishment in case of violation of the articles of the Act. RERA in Bihar is applicable to all residential, commercial, mixed use, and even plotting projects and not only projects coming under the planning area.
Initially the builders were given time till 30th November, 2017 to get the ongoing projects registered. Unlike many of the eastern states, RERA Bihar was the first of few to actually set up a web portal for the registration as well.
All of the early promises have been diluted by very poor implementation of the Act in the state. Absence of the concept of OC and CC in the state for a lengthy period of time (*Since 2002) is partly the reason. Apart from this, the online registration process has not been implemented to scale and the process of registration is still offline. The date of registration of project without any penalty was even extended to 31st January, 2018, which is again expected to be extended further.
Promoters are mostly trying to avoid the process of registration for their ongoing projects since it is becoming extremely painful for them to organize the already messed up project details. Sadly, till date not even a single project/agent has been registered under RERA, Bihar.
